In New York State, the Surrogate's Court handles all probate and estate proceedings.
All wills are probated in this court and all estates of people who die without a
will are handled in this court. The Judge in charge of this Court is called the Surrogate.
The Surrogate's Court is established in every county and hears cases involving the
affairs of decedents, including the probate of wills and the administration of estates,
guardianships, and adoptions. Surrogates are elected to 10-year terms in each county
outside New York City and to 14-year terms in each county in New York City.
If a relative dies, the Surrogate's Court is where the business of winding up his
or her estate would be handled. We have provided addresses and telephone numbers
of Surrogate's Courts located in New York City and Long Island.
